The Department of Health and Human Services, Office of the Inspector General (OIG),
and the Department of Justice have intensified their efforts to investigate and prosecute healthcare fraud and abuse.
Specifically, they have increased enforcement efforts with respect to the Anti-Kickback Statute and Stark Law.
Recent cases have highlighted the need for providers and physicians to monitor, review, and if necessary,
restructure financial arrangements regarding space, equipment, and professional services.
For example, in one recent case, a hospital entered into a settlement agreement with the Government whereby it paid millions of dollars for allegedly entering into arrangements and paying physicians for improper referrals.
Additionally, the OIG recently solicited proposals and recommendations for developing new safe harbors and special fraud alerts related to the Anti-Kickback Statute.
